CrowSpeak Language Practice Terms of Service

These Terms of Service (“Terms”) govern your use of the CrowSpeak Language Practice mobile application (the “App”) and any related services (collectively, the “Service”) operated by Elayne Petterson (“we”, “us”, or “our”).

1. Acceptance of These Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

The Service is intended for users aged 13 and older. By using the Service, you represent that you are at least 13 years old and that you can form a binding contract with us.

3. The Service

The Service provides prompts and tools for self-directed language practice, including the ability to submit text and audio responses and view your practice history.

4. Accounts

4.1 One account per user

You may not create multiple accounts to evade enforcement or restrictions.

4.2 Account security

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

4.3 Usernames and impersonation

You may not use usernames that are profane, misleading, or that impersonate another person or entity.

5. User Content

“User Content” means the text and audio you submit through the Service.

5.1 Ownership

You own your User Content.

5.2 Limited license to operate the Service

You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and display your User Content solely to operate, maintain, and provide the Service to you (for example, saving your history and showing it back to you).

5.3 No third-party content

You agree not to submit content that you do not have the right to submit, including copyrighted or proprietary material owned by third parties.

5.4 Backups and retention

We do not guarantee that your User Content will be available or retained indefinitely. You are responsible for maintaining your own copies or backups of any User Content you wish to keep.

6. Prohibited Conduct

You agree not to use the Service to:

• post or submit hate speech, harassment, or abusive content;
• post or submit illegal content or content that facilitates wrongdoing;
• upload malware, spam, or attempt to interfere with the Service’s operation;
• attempt to bypass authentication, access other users’ data, or probe for vulnerabilities;
• reverse engineer, decompile, or attempt to extract source code (except where prohibited by law);
• use the Service in a way that violates applicable laws or regulations.

7. Intellectual Property

7.1 Our content

The Service, including the app code, user interface, quest prompts/content, branding, and all related materials, is owned by us and is protected by intellectual property laws.

7.2 No copying or redistribution

You may not copy, reproduce, distribute, publish, or create derivative works from the Service or the quest prompts/ content without our prior written permission.

7.3 License to use the App

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App for your own personal, non-commercial use. We may revoke this license at any time if you violate these Terms.

7.4 Commercial use

The Service is intended for personal use. You may not use the Service for commercial purposes (for example, as part of a paid teaching/coaching product, business training program, or other commercial offering) without our prior written permission.

8. Educational Use; Disclaimers

The Service is provided for educational purposes only, as prompts for self-directed language practice. We do not guarantee any learning outcomes.

The Service does not provide medical, legal, financial, mental health, or other professional advice. Any references to health or other topics are intended only as language-learning prompts.

You are responsible for any third-party content you choose to access (such as videos, blogs, or articles) and we are not responsible for third-party content.

9. Changes to the Service

We may change, update, add, or remove quests, features, or functionality at any time. We may also suspend or discontinue the Service (in whole or in part), including for maintenance or operational reasons.

9.1 App updates and availability

The App may update automatically from time to time. The Service may not be available at all times, and some features may depend on your device, operating system, settings, and internet connection.

9.2 Support

We may offer support for the Service, but we do not guarantee that support will be available at any particular time or that we will be able to resolve every issue.

9.3 Feedback

If you submit feedback, ideas, or suggestions about the Service, you agree that we may use them without restriction or compensation to you.

9.4 Third-party services

The Service may rely on third-party services and platforms (for example, Apple, Google, and hosting/analytics providers). We are not responsible for outages or disruptions caused by those third parties.

10. Subscriptions and Payments

10.1 Subscription tiers

The Service offers a free tier and a Pro subscription, available on a monthly or yearly basis. Pro unlocks additional practice tracks and features. Your current tier determines which content and features are accessible to you.

10.2 Billing and renewal

Subscriptions are purchased and managed through Apple's App Store. By purchasing a subscription, you authorize Apple to charge your Apple ID account on a recurring basis at the then-current subscription price. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours before the end of the current period. If a free trial is offered, any unused portion of a free trial period will be forfeited when you purchase a subscription.

10.3 Cancellation and access

You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then. After cancellation, your account reverts to the free tier.

10.4 Refunds

All payments are processed by Apple. Refund requests must be submitted to Apple directly through the App Store. We do not process subscription refunds.

10.5 Price changes

We may change subscription prices from time to time. Apple will notify you of price changes before they take effect, and your continued subscription after the change constitutes acceptance of the new price.

10.6 Future features

The Service currently does not provide AI features, but we may add features in the future (for example, AI-assisted feedback). If we do, additional terms may apply.

11. Ads

The Service may display advertisements in the future.

12. Termination and Enforcement

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms or if it is necessary to protect the Service, other users, or us.

13. Privacy

Our Privacy Policy explains how we collect, use, and share information. By using the Service, you agree that we may handle your information as described in our Privacy Policy:

14. App Store Terms (Apple)

If you downloaded the App from Apple’s App Store, you acknowledge that:

• These Terms are an agreement between you and us, not Apple.
• Apple is not responsible for the App or the Service, including support, maintenance, or addressing claims relating to the App.
• To the extent permitted by law, Apple has no warranty obligations with respect to the App.
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

17. Indemnification

You agree to indemnify and hold us harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

18. Dispute Resolution

Before filing a claim, you agree to contact us at support@crowspeaklanguage.com and attempt to resolve the dispute informally.

19. Venue and Jurisdiction

Except for claims that may be brought in small claims court, any dispute, claim, or lawsuit arising out of or related to the Service or these Terms will be brought exclusively in the state or federal courts located in the State of Utah, and you and we consent to the personal jurisdiction of those courts.

20. Changes to These Terms

We may modify these Terms from time to time. If we do, we will update the “Last updated” date at the top of these Terms and may provide additional notice if required by law. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.

21. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles.

22. Assignment

You may not assign or transfer these Terms or your rights to use the Service without our prior written consent. We may assign these Terms (for example, in connection with forming an LLC, a merger, acquisition, reorganization, or sale of assets) without restriction.

23. Export Controls and Sanctions

You may not use, export, re-export, or transfer the Service except as authorized by United States law and the laws of the jurisdiction where you use the Service. In particular, the Service may not be used by anyone located in a country subject to U.S. embargo, or by any person or entity prohibited under U.S. sanctions or export control laws.

24. Miscellaneous

• Severability: If any provision is found unenforceable, the remaining provisions will remain in effect.
• No waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
• Survival: Sections intended by their nature to survive termination will survive, including provisions about intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.
• Entire agreement: These Terms, together with the Privacy Policy, form the entire agreement between you and us regarding the Service.
